International Child Abduction

Texas Child Custody Attorney

Over the past few decades, it has become increasingly common for mothers, fathers and children to be residents of more than one country. This can present certain legal complications in divorce cases, as it is often difficult to determine which country is responsible for deciding child custody matters. In addition, it can also lead to serious concerns regarding international child abduction.

The Hague Convention

The Hague Convention on Civil Aspects of International Child Abduction requires participating countries to collaborate on the return of a missing child to his or her home country. The United States officially implemented the terms of the Hague Convention (became a participating country) with the passing of the International Child Abduction Remedies Act.

Cases involving international child abduction are extremely complex. First and foremost, the primary objective is always getting a child back to the safety of his or her country of origin. Second, these cases often require extensive work between attorneys in the United States and the country to which the child was taken.
